PART 1: TERMS AND CONDITIONS
1. Introduction
By using our website or purchasing products from Neils Cycles (Pty) Ltd T/A Kroff Cycles (hereinafter referred to as Kroff), you agree to be bound by these terms. These terms apply to all users, including walk-in customers and online shoppers.
2. Pricing and Payments
- All prices are quoted in South African Rand (ZAR) and include VAT unless otherwise stated.
- We reserve the right to change prices at any time due to supplier increases or exchange rate fluctuations.
- Orders are only confirmed once payment has cleared in our bank account.
- We accept payments via EFT, Visa, Mastercard, and PayFast.
3. Delivery and Risk
- Risk of loss or damage passes to the customer upon direct delivery in our shop OR to the nominated address when bought online.
- While we use reputable couriers, we are not liable for delays caused by third-party logistics.
- Customers must inspect the packaging upon receipt. Any visible damage must be noted on the delivery note and reported to us within 24 hours.
4. Assembly and Safety (Critical)
- Bicycles shipped in boxes are partially disassembled for transit.
- Warranty Requirement: To ensure safety and maintain your warranty, Kroff strongly recommends that all bicycles be assembled by a qualified bicycle technician.
- Kroff cannot be held liable for mechanical failure or injury resulting from incorrect self-assembly or “home builds.”
5. Product Availability
- Bicycle stock moves quickly. If a product is out of stock after you have placed an order, we will offer an alternative or a full refund within 30 days.
6. Liability and Indemnity
- Cycling is an inherently risky activity. Kroff is not liable for any injury, loss, or damage arising from the use of products sold, except where such liability is mandatory under the CPA (e.g., gross negligence or manufacturing defects).
7. Governing Law
- These terms are governed by the laws of the Republic of South Africa.
PART 2: REFUND AND CANCELLATION POLICY
In accordance with the Consumer Protection Act, our policy is as follows:
1. Cancellations
- Before Dispatch: You may cancel an order before it has been dispatched. A 5% administration fee may be charged to cover payment processing costs.
- Special Orders: If a bicycle or component was specifically ordered for you (not part of our standard stock), a cancellation fee of up to 50% may apply to cover handling and supplier restocking fees.
2. Cooling-Off Period (Online/Direct Marketing)
- In terms of Section 16 of the CPA, if you purchased via direct marketing, you have a 5-business-day “cooling-off” period after receiving the goods to return them for a refund, no questions asked. The cost of return shipping is the responsibility of the consumer.
3. Returns for “Change of Heart”
- If you are not satisfied with your purchase (and it is not defective), you may return it within 7 days, provided:
- The item is in its original, unopened packaging.
- The item has not been used or fitted (e.g., a bike has not been ridden).
- You have the original proof of purchase.
- Note: We do not accept returns on “wear-and-tear” items like tires, tubes, or brake pads once they have been fitted.
4. Defective Goods (Implied Warranty)
- Under Sections 55 and 56 of the CPA, you have the right to receive goods that are of good quality and free of defects.
- If a product is found to be defective within 6 months of purchase, you are entitled to a repair, replacement, or refund.
- Exclusions: This warranty does not cover damage caused by:
- Normal wear and tear (chain stretch, tire wear, etc.).
- Abuse, neglect, or accidents.
- Improper assembly (see Section 4 of T&Cs).
- Modifications not approved by the manufacturer.
5. Refund Process
- Refunds will be processed via the original payment method within 10 to 30 days of the return being approved.
- Shipping costs are generally non-refundable unless the item is defective.
